UMFANG UND ERLAUBNIS DER VERARBEITUNG PERSONENBEZOGENER DATEN
Wir erheben und verwenden personenbezogene Daten unserer Nutzer grundsätzlich nur, soweit dies zur Bereitstellung der Funktionsfähigkeit unserer Internetseite sowie unserer Inhalte und Leistungen erforderlich ist. Die Erhebung und Verwendung personenbezogener Daten unserer Nutzer erfolgt regelmäßig nur nach Einwilligung des Nutzers. Eine Ausnahme gilt in solchen Fällen, in denen eine vorherige Einholung einer Einwilligung aus tatsächlichen Gründen nicht möglich ist und die Verarbeitung der Daten durch gesetzliche Vorschriften gestattet ist. Rechtsgrundlage für Verarbeitungsvorgänge personenbezogener Daten bei vorheriger Einholung einer Einwilligung der betroffenen Person, ist Art. 6 Abs. 1 lit. a DSGVO. Für die Verarbeitung personenbezogener Daten, die zur Erfüllung eines Vertrages oder zur Durchführung vorvertraglicher Maßnahmen erforderlich sind, ist Rechtsgrundlage Art. 6 Abs. 1 lit. b DSGVO. Bei der Verarbeitung personenbezogener Daten zur Erfüllung einer rechtlichen Verpflichtung ist Rechtsgrundlage Art. 6 Abs. 1 lit. c DSGVO. Für den Fall, dass lebenswichtige Interessen der betroffenen Person oder einer anderen natürlichen Person eine Verarbeitung personenbezogener Daten erforderlich machen, dient Art. 6 Abs. 1 lit. d DSGVO als Rechtsgrundlage. Ist die Verarbeitung zur Wahrung eines berechtigten Interesses unseres Unternehmens oder eines Dritten erforderlich und überwiegen diese Interessen dem Interesse des Betroffenen unter Berücksichtigung der Grundrechte und Grundfreiheiten des Betroffenen ist Art. 6 Abs. 1 lit. f DSGVO die Rechtsgrundlage für die Verarbeitung der Daten.
DATENLÖSCHUNG UND SPEICHERDAUER
Die personenbezogenen Daten der betroffenen Person werden gelöscht oder gesperrt, sobald der Zweck der Speicherung entfällt. Eine Speicherung kann darüber hinaus dann erfolgen, wenn dies wir aufgrund einer gesetzlichen Vorschrift zur Verarbeitung der Daten vorgesehen ist. Eine Sperrung oder Löschung der Daten erfolgt in diesem Fall, wenn die gesetzlich vorgeschriebene Speicherfrist abläuft, es sei denn, dass eine Erforderlichkeit zur weiteren Speicherung der Daten für einen Vertragsabschluss oder eine Vertragserfüllung besteht.
DATENVERARBEITUNG DURCH NUTZUNG UNSERER INTERNETSEITE
Beim Aufrufen unserer Internetseite werden durch den auf Ihrem Endgerät zum Einsatz kommenden Browser automatisch Informationen an den Server unserer Website gesendet. Diese Informationen werden temporär in einem sog. Logfile gespeichert. Folgende Informationen werden dabei ohne Ihr Zutun erfasst und bis zur automatisierten Löschung gespeichert: IP-Adresse des anfragenden Rechners, Datum und Uhrzeit des Zugriffs, Name und URL der abgerufenen Datei, Website, von der aus der Zugriff erfolgt (Referrer-URL), verwendeter Browser und ggf. das Betriebssystem Ihres Rechners sowie der Name Ihres Access-Providers. Die genannten Daten werden durch uns zu den Zwecken Gewährleistung eines reibungslosen Verbindungsaufbaus der Website, Gewährleistung einer komfortablen Nutzung unserer Website, Auswertung der Systemsicherheit und -stabilität sowie zu weiteren administrativen Zwecken verarbeitet. Die Rechtsgrundlage für die Datenverarbeitung ist Art. 6 Abs. 1 S. 1 lit. f DSGVO. Unser berechtigtes Interesse folgt aus oben aufgelisteten Zwecken zur Datenerhebung. In keinem Fall verwenden wir die erhobenen Daten zu dem Zweck, Rückschlüsse auf Ihre Person zu ziehen.
NUTZUNG ONLINE-SHOP FUNKTIONEN
Wir verarbeiten die Daten unserer Kunden im Rahmen der Bestellvorgänge in unserem Onlineshop, um ihnen die Auswahl und die Bestellung der gewählten Produkte und Leistungen, sowie deren Bezahlung und Zustellung, bzw. Ausführung zu ermöglichen. Zu den verarbeiteten Daten gehören Bestandsdaten, Kommunikationsdaten, Vertragsdaten, Zahlungsdaten und zu den von der Verarbeitung betroffenen Personen gehören unsere Kunden, Interessenten und sonstige Geschäftspartner. Die Verarbeitung erfolgt zum Zweck der Erbringung von Vertragsleistungen im Rahmen des Betriebs eines Onlineshops, Abrechnung, Auslieferung und der Kundenservices. Hierbei setzen wir Session Cookies für die Speicherung des Warenkorb-Inhalts und permanente Cookies für die Speicherung des Login-Status ein. Die Verarbeitung erfolgt auf Grundlage des Art. 6 Abs. 1 lit. b (Durchführung Bestellvorgänge) und c (Gesetzlich erforderliche Archivierung) DSGVO. Dabei sind die als erforderlich gekennzeichneten Angaben zur Begründung und Erfüllung des Vertrages erforderlich. Die Daten offenbaren wir gegenüber Dritten nur im Rahmen der Auslieferung, Zahlung oder im Rahmen der gesetzlichen Erlaubnisse und Pflichten gegenüber Rechtsberatern und Behörden. Die Daten werden in Drittländern nur dann verarbeitet, wenn dies zur Vertragserfüllung erforderlich ist (z.B. auf Kundenwunsch bei Auslieferung oder Zahlung). Nutzer können optional ein Nutzerkonto anlegen, indem sie insbesondere ihre Bestellungen einsehen können. Im Rahmen der Registrierung, werden die erforderlichen Pflichtangaben den Nutzern mitgeteilt. Die Nutzerkonten sind nicht öffentlich und können von Suchmaschinen nicht indexiert werden. Wenn Nutzer ihr Nutzerkonto gekündigt haben, werden deren Daten im Hinblick auf das Nutzerkonto gelöscht, vorbehaltlich deren Aufbewahrung ist aus handels- oder steuerrechtlichen Gründen entspr. Art. 6 Abs. 1 lit. c DSGVO notwendig. Angaben im Kundenkonto verbleiben bis zu dessen Löschung mit anschließender Archivierung im Fall einer rechtlichen Verpflichtung. Es obliegt den Nutzern, ihre Daten bei erfolgter Kündigung vor dem Vertragsende zu sichern. Im Rahmen der Registrierung und erneuter Anmeldungen sowie Inanspruchnahme unserer Onlinedienste, speichern wir die IP-Adresse und den Zeitpunkt der jeweiligen Nutzerhandlung. Die Speicherung erfolgt auf Grundlage unserer berechtigten Interessen, als auch der Nutzer an Schutz vor Missbrauch und sonstiger unbefugter Nutzung. Eine Weitergabe dieser Daten an Dritte erfolgt grundsätzlich nicht, außer sie ist zur Verfolgung unserer Ansprüche erforderlich oder es besteht hierzu eine gesetzliche Verpflichtung gem. Art. 6 Abs. 1 lit. c DSGVO. Die Löschung erfolgt nach Ablauf gesetzlicher Gewährleistungs- und vergleichbarer Pflichten, die Erforderlichkeit der Aufbewahrung der Daten wird alle drei Jahre überprüft; im Fall der gesetzlichen Archivierungspflichten erfolgt die Löschung nach deren Ablauf (Ende handelsrechtlicher (6 Jahre) und steuerrechtlicher (10 Jahre) Aufbewahrungspflicht).
NUTZUNG UNSERES KONTAKTFORMULARS
Auf unserer Internetseite ist ein Kontaktformular vorhanden, welches für die elektronische Kontaktaufnahme genutzt werden kann. Nimmt ein Nutzer diese Möglichkeit wahr, so werden die in das Kontaktformular eingegeben Daten sowie die IP Adresse, das Datum und die Uhrzeit an uns übermittelt und gespeichert. Für die Verarbeitung der Daten wird im Rahmen des Absendevorgangs Ihre Einwilligung eingeholt und auf diese Datenschutzerklärung verwiesen. Rechtsgrundlage für die Verarbeitung der Daten ist in diesem Fall Art. 6 Abs. 1 lit. a DSGVO. Alternativ ist eine Kontaktaufnahme über die bereitgestellte E-Mail-Adresse möglich. In diesem Fall werden die mit der E-Mail übermittelten personenbezogenen Daten des Nutzers gespeichert. Es erfolgt in diesem Zusammenhang keine Weitergabe der Daten an Dritte. Rechtsgrundlage für die Verarbeitung dieser Daten ist Art. 6 Abs. 1 lit. f DSGVO. Zielt der E-Mail-Kontakt auf den Abschluss eines Vertrages ab, so ist zusätzliche Rechtsgrundlage für die Verarbeitung Art. 6 Abs. 1 lit. b DSGVO. Die Datenverarbeitung zum Zwecke der Kontaktaufnahme mit uns erfolgt nach Art. 6 Abs. 1 S. 1 lit. a DSGVO auf Grundlage Ihrer freiwillig erteilten Einwilligung. Die für die Benutzung des Kontaktformulars von uns erhobenen personenbezogenen Daten werden nach Erledigung der von Ihnen gestellten Anfrage automatisch gelöscht. NEWSLETTER Wir bieten Ihnen auf unserer Internetseite die Möglichkeit, unseren Newsletter zu abonnieren. Mit diesem Newsletter informieren wir in regelmäßigen Abständen über unsere Angebote. Um unseren Newsletter empfangen zu können, benötigen Sie eine gültige E-Mail-Adresse. Die von Ihnen eingetragene E-Mail-Adresse werden wir dahingehend überprüfen, ob Sie tatsächlich der Inhaber der angegebenen E-Mail-Adresse sind bzw. deren Inhaber den Empfang des Newsletters autorisiert ist. Mit Ihrer Anmeldung zu unserem Newsletter werden wir Ihre IP-Adresse und das Datum sowie die Uhrzeit Ihrer Anmeldung speichern. Dies dient in dem Fall, dass ein Dritter Ihre E-Mail-Adresse missbraucht und ohne Ihr Wissen unseren Newsletter abonniert, als Absicherung unsererseits. Weitere Daten werden unsererseits nicht erhoben. Die so erhobenen Daten werden ausschließlich für den Bezug unseres Newsletters verwendet. Eine Weitergabe an Dritte erfolgt nicht. Ein Abgleich der so erhobenen Daten mit Daten, die möglicherweise durch andere Komponenten unserer Seite erhoben werden, erfolgt ebenfalls nicht. NEWSLETTER-TRACKING
Unsere Newsletter enthalten sogenannte Zählpixel. Ein Zählpixel ist eine Miniaturgrafik, die in solche E-Mails eingebettet wird, welche im HTML-Format versendet werden, um eine Logdatei-Aufzeichnung und eine Logdatei-Analyse zu ermöglichen. Dadurch kann eine statistische Auswertung des Erfolges oder Misserfolges von Online-Marketing-Kampagnen durchgeführt werden. Anhand des eingebetteten Zählpixels können wir erkennen, ob und wann eine E-Mail von einer betroffenen Person geöffnet wurde und welche in der E-Mail befindlichen Links von der betroffenen Person aufgerufen wurden. Solche über die in den Newslettern enthaltenen Zählpixel erhobenen personenbezogenen Daten, werden von uns gespeichert und ausgewertet, um den Newsletterversand zu optimieren und den Inhalt zukünftiger Newsletter noch besser den Interessen der betroffenen Person anzupassen. Diese personenbezogenen Daten werden nicht an Dritte weitergegeben. Betroffene Personen sind jederzeit berechtigt, die diesbezügliche gesonderte, über das Double-Opt-In-Verfahren abgegebene Einwilligungserklärung zu widerrufen. Nach einem Widerruf werden diese personenbezogenen Daten von dem für die Verarbeitung Verantwortlichen gelöscht. Eine Abmeldung vom Erhalt unseres Newsletters legen wir immer als Widerruf aus.
WEITERGABE VON DATEN
Eine Übermittlung Ihrer persönlichen Daten an Dritte zu anderen als den im Folgenden aufgeführten Zwecken findet nicht statt. Wir geben Ihre persönlichen Daten nur an Dritte weiter, wenn Sie Ihre nach Art. 6 Abs. 1 S. 1 lit. a DSGVO ausdrückliche Einwilligung dazu erteilt haben, die Weitergabe nach Art. 6 Abs. 1 S. 1 lit. f DSGVO zur Geltendmachung, Ausübung oder Verteidigung von Rechtsansprüchen erforderlich ist und kein Grund zur Annahme besteht, dass Sie ein überwiegendes schutzwürdiges Interesse an der Nichtweitergabe Ihrer Daten haben, für den Fall, dass für die Weitergabe nach Art. 6 Abs. 1 S. 1 lit. c DSGVO eine gesetzliche Verpflichtung besteht, sowie dies gesetzlich zulässig und nach Art. 6 Abs. 1 S. 1 lit. b DSGVO für die Abwicklung von Vertragsverhältnissen mit Ihnen erforderlich ist.
VERWENDUNG VON COOKIES
Wir verwenden für den Betrieb unserer Internetseite Cookies, um diese nutzerfreundlicher zu gestalten. Einige Elemente unserer Internetseite erfordern es, dass der aufrufende Browser auch nach einem Seitenwechsel identifiziert werden kann. EINSATZ VON GOOGLE-DIENSTEN
Auf unserer Website setzen wir verschiedene Dienste der Google Ireland Limited („Google“), Gordon House, Barrow Street, Dublin 4, Irland, ein. Ausführliche Informationen zu den jeweils konkret verwendeten Google-Diensten finden Sie in den nachfolgenden Abschnitten dieser Datenschutzerklärung. Durch die Einbindung der Google-Dienste kann es dazu kommen, dass Google Informationen – einschließlich personenbezogener Daten – erhebt und verarbeitet. Auf unserer Website setzen wir Google Analytics ein. Google Analytics verwendet Cookies, also Textdateien, die auf Ihrem Endgerät gespeichert werden und eine Analyse der Nutzung der von Ihnen besuchten Webseiten ermöglichen. FACEBOOK PIXEL, FACEBOOK CUSTOM AUDIENCES UND FACEBOOK CONVERSIONS
Auf unserer Website setzen wir Marketing- und Analysefunktionen des sozialen Netzwerks Facebook ein. Konkret nutzen wir das Facebook Pixel, Facebook Custom Audiences sowie Facebook Conversions. Auf unserer Website setzen wir das TikTok-Pixel ein. BREVO (NEWSLETTER UND E-MAIL-MARKETING)
Für den Versand von Newslettern nutzen wir den Dienst Brevo der Sendinblue GmbH. Die von Ihnen zum Zwecke des Newsletterbezugs eingegebenen personenbezogenen Daten werden auf den Servern von Brevo verarbeitet. Brevo ermöglicht uns die statistische Auswertung von Newsletterkampagnen. Die Anmeldung erfolgt im Double-Opt-In-Verfahren. Die Verarbeitung Ihrer personenbezogenen Daten erfolgt auf Grundlage Ihrer Einwilligung gemäß Art. 6 Abs. 1 lit. a DSGVO. Mit Brevo wurde ein Vertrag über Auftragsverarbeitung gemäß Art. 28 DSGVO abgeschlossen. Terms & Conditions
1. CONTRACTING PARTIES AND SCOPE OF APPLICATION OF THESE TERMS AND CONDITIONS
1.1 These General Terms and Conditions shall apply exclusively to all business relations between WHOLE GmbH, Schönhauser Allee 167a, 10435 Berlin, Germany, represented by its managing directors Raquel Fedato Pogoda, Giacomo Garavelloni and Cristian Pereira Phillips (hereinafter referred to as the "Seller" or "we"), and the customer. The version of these General Terms and Conditions valid at the time the order is placed shall apply, unless expressly agreed otherwise. Any deviating or conflicting terms and conditions of the customer shall not be recognised unless the Seller has expressly agreed to their applicability in writing.
1.2 For the purposes of Section 13 of the German Civil Code (Bürgerliches Gesetzbuch – BGB), a consumer is any natural person who enters into a legal transaction for purposes which predominantly cannot be attributed to their commercial or independent professional activity.
2. OBLIGATIONS OF THE CUSTOMER
2.1 The customer is obliged to provide truthful and complete information when placing an order. The customer shall notify us without undue delay, and at the latest prior to the next order, of any changes to data relevant to the business relationship (e.g. name, address, email address). If incorrect or false data is provided, we shall be entitled to withdraw from any contracts already concluded.
2.2 Order processing and communication generally take place via email and automated order processing systems. The customer shall ensure that the email address provided for the purpose of order processing is correct and that emails sent by the Seller can be received at this address. In particular, where spam filters are used, the customer shall ensure that all emails sent by the Seller or by third parties commissioned by the Seller to process orders can be successfully delivered.
3. CONCLUSION OF CONTRACT / TECHNICAL STEPS LEADING TO THE CONCLUSION OF THE CONTRACT / CONTRACT LANGUAGE
3.1 The presentation of tickets and/or services does not constitute a legally binding offer. By submitting a chargeable order via the internet, fax, telephone or email, the customer submits a binding offer to conclude a contract. The Seller reserves the right to freely decide on the acceptance of the offer. Acceptance shall take place by means of an order confirmation. If the customer does not receive an order confirmation within two weeks, the customer shall no longer be bound by their order.
3.2 Information on the technical steps leading to the conclusion of the contract
3.2.1 On the offer page, the customer may place products in the shopping basket by clicking the "Add to basket" button or a corresponding graphical symbol. Once the customer has placed all desired products in the shopping basket, the ordering process can be initiated by clicking the "Checkout" button.
3.2.2 In the next step, the customer may either register for the first time by entering their personal details or log in using existing access data by entering their email address and password and subsequently clicking the "Log in" button.
3.2.3 Alternatively, an order may also be placed without creating a customer account. In this case, the customer must provide details of the billing and delivery address as well as their email address.
3.2.4 An overview page will then be displayed showing the billing and delivery address, as well as a field for entering delivery instructions. The customer may select their preferred payment method in the field below. After selecting the payment method, the General Terms and Conditions will be displayed and must be accepted by the customer by activating the corresponding checkbox. Below this, the customer will be shown an overview of the selected products. Prior to the binding submission of the order, the customer may correct their entries at any time using the usual keyboard and mouse functions. For this purpose, the browser's "Back" function may be used to return to the shopping basket, where the selected products and quantities may be changed and corrected. At the end of the page, the customer clicks the "Place order with obligation to pay" button or another button clearly labelled in accordance with Section 312j (3) of the German Civil Code (BGB). A page confirming the customer's order will then be displayed.
3.3 Acceptance by the Seller shall take place in accordance with Clause 3.1.
3.4 The contract text shall be made available in German and English. In the event of discrepancies, the German version shall prevail.
4. WHOLE FESTIVAL TICKETS
4.1 The conclusion of the contract between the customer and us takes place in particular via our distribution partners (e.g. Weeztix B.V.), who broker the sale of tickets in our name and for our account. In addition to these General Terms and Conditions, the general terms and conditions of our distribution partners shall apply. In addition to these General Terms and Conditions, the respective distribution partner's terms and conditions may apply to the ticket purchase insofar as the distribution partner provides its own services in its own name (e.g. payment processing, ticket dispatch, service fees). These General Terms and Conditions shall take precedence with regard to all provisions governing the contractual relationship between you and us as the event organiser (in particular admission, performance/cancellation/postponement of the event, and house rules). Mandatory or overriding provisions of the distribution partner relating to its own services shall remain unaffected. In addition, separate notices, in particular those issued by distribution partners, relating to events (e.g. identification and prevention measures as well as obligations to cooperate in connection with epidemics and pandemics, such as SARS-CoV-2 (including mutations and variants), ticket personalisation, prohibition of transfer, ticket dispatch dates, etc.) must be observed.
4.2 The ticket purchase price, which consists of the base ticket price, advance booking fee, system fee and any other fees, in each case including statutory VAT (hereinafter the "Ticket Purchase Price"), shall be due for payment immediately upon conclusion of the contract and shall be payable to us in full. Distribution partners may additionally charge further fees in their own name.
4.3 Tickets are sold via our distribution partners subject to retention of title, meaning that the tickets shall remain our property until the Ticket Purchase Price has been paid in full and shall not entitle the holder to admission to the event until such payment has been completed.
4.4 We provide services in the field of leisure activities for which a specific date or period is stipulated (admission tickets for the Whole Festival). For such contracts, there is no right of withdrawal pursuant to Section 312g (2) no. 9 of the German Civil Code (BGB). Each order for admission tickets is therefore binding upon confirmation by the respective distribution partner and obliges the customer to accept and pay for the tickets ordered.
4.5 The commercial or professional resale of admission tickets is prohibited. In particular, a resale shall be deemed commercial if admission tickets are offered or sold at a price higher than the original ticket price including fees, if the resale is carried out with the intention of making a profit, or if admission tickets are offered or transferred via third-party platforms or marketplaces not authorised by us, in particular via platforms such as Viagogo, eBay, Kleinanzeigen, TicketSwap or comparable services. Any permitted transfer or re-personalisation of admission tickets may only take place via the transfer method authorised by us; this currently takes place via the Tixel platform or another transfer mechanism expressly designated by us. Any transfer outside this authorised procedure is prohibited. In the event of a breach of these provisions, we shall be entitled to block, deactivate or invalidate the affected ticket, with the result that no right of admission to the event shall exist. In such cases, there shall be no entitlement to a refund of the ticket price, provided that the breach is attributable to the ticket holder. Statutory rights shall remain unaffected. Any further rights, in particular arising from our house rules and any claims for damages, are expressly reserved.
5. CANCELLATION OR POSTPONEMENT OF THE EVENT / LIMITATION OF THE PERMITTED NUMBER OF ATTENDEES
5.1 We shall be entitled to cancel or postpone the festival or individual event days prior to the commencement of the festival or the respective event day for reasons beyond our control, in particular in cases of artist cancelations, force majeure as well as due to restrictions in connection with epidemics or pandemics (e.g. SARS-CoV-2, including all mutations and variants).
5.2 If the festival or an event day is cancelled in accordance with Clause 5.1, the ticket shall lose its validity to that extent and shall no longer entitle the holder to admission. The ticket holder may claim a refund of the base ticket price attributable to the cancelled part from the respective distribution partner within 30 days after the originally scheduled event date. Clause 5.5 shall apply accordingly. The deadline shall not apply if the failure to comply with it is not attributable to the ticket holder; this must be demonstrated upon request.
5.3 If the festival or an event day is postponed in accordance with Clause 5.1, the tickets shall remain valid. However, the ticket holder shall be entitled to return the ticket. A claim for a refund of the base ticket price shall exist exclusively in the event of such return and must be asserted against the respective distribution partner no later than 24:00 on the day preceding the rescheduled date. Clause 5.5 shall apply accordingly. Any failure to meet the deadline through no fault of the ticket holder must be demonstrated accordingly.
5.4 The processing of ticket returns shall be governed by the general terms and conditions of the respective distribution partner.
5.5 Provided that the requirements of Clauses 5.2 or 5.3 in conjunction with Clause 5.4 are met, only the base ticket price including statutory VAT shall be refunded, provided that the ticket has been returned or effectively invalidated/deactivated for the purpose of reimbursement in accordance with the requirements of the respective distribution partner (e.g. by returning the original ticket/print@home ticket or – in the case of electronic tickets – by technical deactivation/cancellation). No further reimbursement shall be made. Advance booking fees, system fees or service fees shall generally not be refunded insofar as these have been incurred for services already rendered (in particular ticket brokerage, payment processing, use of the ticketing system). To the extent that a claim for reimbursement of such fees should exist in principle, we hereby declare set-off against our claim for compensation for value in the corresponding amount.
5.6 With regard to any fees charged by the respective distribution partner and their possible reimbursement, exclusively the general terms and conditions of the respective distribution partner shall apply.
5.7 If statutory provisions, official orders, general rulings or official recommendations of the Federal Government, the federal states or recognised research institutes (e.g. the Robert Koch Institute) in connection with epidemics or pandemics do not mandatorily require the cancellation of the festival, we shall be entitled to hold the festival in compliance with the applicable restrictions. If this results in a subsequent limitation of the permitted number of attendees such that not all ticket holders can be granted admission, the selection of the tickets that remain valid shall be carried out using a transparent, randomised procedure. The affected ticket holders shall be informed without undue delay. For tickets that lose their validity, Clauses 5.2 et seq. shall apply accordingly.
5.8 The above provisions shall not affect any statutory claims of ticket holders insofar as such claims are based on a breach of duty for which we are responsible.
6. ADMISSION TO THE EVENT
6.1 Admission to the festival site is permitted exclusively with a valid, fully paid and personalised admission ticket. Each ticket is issued to a specific individual and is personalised at the time of order or subsequently via the personalisation platform provided by us or by the respective distribution partner, in the name of a specific person (the "ticket holder"). Only the ticket holder is entitled to admission. Any transfer, passing on or other use of the ticket by third parties is excluded unless we have expressly approved a re-personalisation to another person in text form (e.g. by email) in advance. Upon request, the ticket holder must present an official photo ID at the entrance for verification. If personalisation has not been carried out, has been carried out incompletely, or if the details do not match the identification document, we may refuse admission; in such cases, a right to reimbursement shall exist only insofar as the ticket holder is not responsible for the missing or incorrect personalisation or the discrepancy.
6.2 Upon first entry to the festival site, the admission ticket shall be invalidated and the visitor shall be issued with a festival wristband. Upon re-entry to the festival site and upon request by our security staff, the festival wristband must be presented. Manipulated, unfastened, torn, lost or significantly damaged festival wristbands shall lose their validity. There shall be no entitlement to replacement.
6.3 We shall be entitled to refuse admission to visitors or to expel them from the festival site for good cause. If the good cause does not lie within the person of the visitor, a claim for reimbursement of the base ticket price shall exist. Any further claims, in particular claims for damages, shall be excluded unless we are guilty of intent or gross negligence.
6.4 Admission to and presence on the entire festival site, including all camping and parking areas, is permitted exclusively to persons who have reached the age of 18. This shall apply irrespective of accompaniment by parents, legal guardians or persons entrusted with parental authority.
6.5 The carrying or use of the following items and content is prohibited throughout the entire festival site, in particular: glass of any kind, in particular bottles and drinking glasses, except on the campsite; firearms, cutting, stabbing or other weapons and weapon-like objects; saws, axes, hatchets and comparable tools; substances listed in Schedules I to III of the German Narcotics Act (Betäubungsmittelgesetz – BtMG); generators of any kind and uninstalled vehicle batteries; pyrotechnic items, explosives or highly flammable substances, in particular flares, fireworks, sparklers, sky lanterns, as well as canisters or other containers with petrol or comparable substances; recording equipment (audio, video, photo or film equipment) which, by its nature or size, is not intended exclusively for private use; noise-generating items such as compressed-air sirens, vuvuzelas, sound systems, megaphones, PA systems or self-built boomboxes; bulky items such as sofas or comparable furniture; laser pointers; confetti; as well as music, flags, banners, stickers, patches or clothing containing unconstitutional content, in particular right-wing extremist content. Further prohibited items may be announced on our website under the FAQs. In the event of violations of these provisions, we or persons authorised by us shall be entitled to expel the visitor from the festival site – in serious cases also without prior warning – and to permanently exclude them from further attendance. In such cases, there shall be no entitlement to re-admission or reimbursement, provided that we are not responsible for the measure taken. Statutory rights shall remain unaffected. In particularly serious cases, we reserve the right to file a criminal complaint.
6.6 Bringing animals onto the festival site is not permitted.
6.7 The permissibility of items or conduct not expressly listed shall be decided on a case-by-case basis by our security staff or another person authorised by us, taking into account the safety, order and health interests of all visitors.
6.8 Any trading or any provision of goods or services in return for payment by visitors is prohibited without our prior express consent. This applies in particular to beverages, food and camping equipment. The carrying of larger quantities of alcoholic beverages may be prohibited if, based on objective circumstances, there is a justified suspicion that such beverages are not intended exclusively for personal consumption.
7. OBLIGATIONS OF VISITORS WHEN ATTENDING THE FESTIVAL
7.1 Prohibited items and participation restrictions: It is prohibited to carry dangerous objects, in particular weapons of any kind, objects suitable for use as projectiles, large gas containers and pyrotechnic items (e.g. flares, fireworks, sparklers). Participation in the event is also prohibited if the visitor knows, or due to culpable ignorance ought to know, that there is a suspicion of an illness listed in Section 6 of the German Infection Protection Act (Infektionsschutzgesetz – IfSG), in particular SARS-CoV-2 (including all mutations and variants). If a visitor fails to comply with or breaches the protective, cooperation or behavioural obligations applicable to the respective event, we shall be entitled to refuse admission to the event or to expel the visitor from the event site. In such cases, there shall be no entitlement to reimbursement or any other claims against us, provided that we are not responsible for the measure taken.
7.2 Measures for health, infection and hazard protection: We shall be entitled, in compliance with the applicable statutory provisions, official orders, general rulings, regulations and official recommendations of the Federal Government, the federal states or recognised research institutes (e.g. the Robert Koch Institute), to order appropriate measures for the detection, prevention and containment of health and infection risks, in particular in connection with epidemics or pandemics (e.g. SARS-CoV-2, including mutations and variants). Such measures may include in particular: the obligation to present a valid and up-to-date negative test result (e.g. SARS-CoV-2 test) in the prescribed form; the presentation of valid proof of immunisation or recovery in accordance with the applicable requirements; participation in rapid tests or other examinations for the detection or exclusion of infectious diseases; participation in health checks (e.g. temperature measurements); compliance with a hygiene concept (e.g. distancing rules, wearing a specified type of face covering, hygiene and disinfection measures); the collection of address and contact data before or during the event (e.g. through ticket personalisation, registration at entry or the use of approved apps); and the provision of other evidence or the fulfilment of further cooperation obligations insofar as these serve the protection of the health of all event participants and are reasonable. Personal data shall be processed in compliance with the applicable data protection laws. Where required by law, we shall be entitled to transmit such data to the competent authorities (e.g. public health authorities).
7.3 Inspections and additional protective measures: We shall be entitled to carry out inspections during the event and to order additional appropriate measures in order to minimise health or infection risks as far as possible. Appropriate measures shall in particular include those based on recommendations of recognised research institutes (e.g. the Robert Koch Institute). Where it appears necessary to protect the health of event participants, we reserve the right to order measures that go beyond statutory minimum requirements, provided that such measures are objectively justified and reasonable. We or our distribution partners shall inform visitors of the applicable measures in good time prior to the event.
7.4 Consequences of non-compliance or breaches: If a visitor fails to comply with or breaches the protective, cooperation or behavioural obligations applicable to the respective event, we shall be entitled to refuse admission to the event or to expel the visitor from the event site. In such cases, there shall be no entitlement to reimbursement or any other claims against us, provided that we are not responsible for the measure taken.
8. HOUSE RULES / EXERCISE OF HOUSEHOLDER'S AUTHORITY
8.1 The instructions of our security staff as well as of other persons clearly authorised by us to exercise householder's authority must be followed at all times.
8.2 Upon entry to the festival site and during the stay, security checks may be carried out by our security staff, in particular body and bag searches. Admission may be refused if a visitor refuses to undergo such checks.
8.3 Where good cause exists, we or persons authorised by us shall be entitled to expel visitors from the festival site – in serious cases also without prior warning – and to permanently exclude them from further attendance at the event. Good cause shall exist in particular if a visitor breaches these General Terms and Conditions, commits criminal offences (e.g. assault, theft, damage to property, possession or trafficking of narcotics, sexual harassment or coercion, insults, environmental pollution), displays xenophobic, sexist or otherwise discriminatory behaviour, sprays, pastes, smears or damages tents, stages, sanitary facilities or third-party property, endangers the health or property of others through their behaviour (e.g. by physical violence, throwing objects, climbing stages, trusses, loudspeaker systems or tents, or by stage diving, moshing or crowd surfing), fails to comply with the instructions of security staff, unlawfully enters restricted or clearly marked areas (e.g. backstage, artist or stage areas), engages in commercial trading without our consent, or urinates in unauthorised areas. In such cases, the admission ticket and festival wristband shall lose their validity. There shall be no entitlement to re-admission or reimbursement of the ticket price, provided that we are not responsible for the measure taken. Statutory rights shall remain unaffected.
8.4 The dissemination or display of unconstitutional, nationalist or right-wing extremist symbols, content or music shall result in immediate and permanent exclusion from the event. In such cases, the admission ticket and festival wristband shall lose their validity. There shall be no entitlement to re-admission or reimbursement of the ticket price, provided that we are not responsible for the measure taken. Further legal steps are expressly reserved.
8.5 Wilful damage to trees, shrubs or other vegetation on the festival site or in adjacent areas is prohibited and may be prosecuted as vandalism.
8.6 The commercial collection of recyclable materials, in particular deposit bottles or metals, is permitted on the festival site only with our prior express written consent. In the event of violations, we shall be entitled to expel the visitor from the festival site; further legal steps remain reserved.
8.7 During events organized by WHOLE GmbH, photographs and video recordings are taken for the purposes of documentation and public relations. This includes, in particular, use on the WHOLE GmbH website, on social media, and in press and promotional materials.
Photographs and video recordings in which individuals are clearly identifiable (portraits within the meaning of Section 22 of the German Copyright Act (KunstUrhG)) are created and processed exclusively on the basis of prior, explicit, and voluntary consent in accordance with Article 6(1)(a) of the GDPR. Consent is obtained on site by the photographers.
Consent may be withdrawn at any time with effect for the future, without the need to give reasons. The withdrawal does not affect the lawfulness of processing carried out prior to the withdrawal.
Independently of this, visitors have the option to obtain a so-called “No Photo Wristband” at the information points to indicate that they do not wish to be photographed or filmed. This serves as an additional guideline for photographers and the event team and does not affect the requirement for explicit consent.
Recordings of public events in which the depicted persons are not the main subject of the image (overview and crowd shots) may be processed on the basis of the statutory permissions set out in Section 23(1)(3) of the German Copyright Act (KunstUrhG).
9. LOCKERS
9.1 When making a booking, you may also conclude a contract for the temporary rental use of a locker located on the festival site. In this respect, we act solely as an intermediary. The contract for the use of the locker is concluded directly between you and Locker Company B.V., Energiestraat 2b, 5961 PT Horst, The Netherlands.
9.2 The General Terms and Conditions of Locker Company B.V. shall apply to the conclusion of the contract between you and the locker operator. These may be viewed on the website of Locker Company B.V.
9.3 Pursuant to Section 312g (2) no. 9 of the German Civil Code (BGB), there is no right of withdrawal for contracts concerning the temporary provision of a locker for a specific date or period.
10. RIGHT OF WITHDRAWAL
There is no right of withdrawal for contracts concerning the provision of admission tickets for the Whole Festival for a specific date or period, nor for contracts concerning the temporary provision of lockers for a specific date or period. In each case, these are contracts for the provision of services in connection with leisure activities and/or accommodation-related services, for which no right of withdrawal exists pursuant to Section 312g (2) no. 9 of the German Civil Code (BGB).
11. PRICES
Unless otherwise stated in the Seller's product description, all prices quoted are total prices and include statutory value added tax (VAT).
12. DAMAGES
Claims for damages are excluded. This shall not apply to claims for damages arising from injury to life, body or health, or from the breach of material contractual obligations, nor to liability for other damages resulting from an intentional or grossly negligent breach of duty on our part. Material contractual obligations are those obligations whose fulfilment is essential to achieving the purpose of the contract. In the event of a breach of material contractual obligations, we shall be liable only for the typical and foreseeable damage, provided that such damage was caused by simple negligence, unless the claim for damages arises from injury to life, body or health. The above limitations of liability shall also apply in favour of our legal representatives and vicarious agents insofar as claims are asserted directly against them.
13. FINAL PROVISIONS
13.1 Any amendments or supplements to this contract shall require text form (e.g. email), unless a stricter form is required by law. This shall also apply to any amendment of this text form clause.
13.2 For merchants, legal entities under public law or special funds under public law, the place of jurisdiction for all disputes arising out of or in connection with this contract shall be the Seller's registered office. Statutory places of jurisdiction shall apply to consumers.
13.3 German law shall apply to consumers and to other persons who have their habitual residence or place of stay in a Member State of the European Union (EU) or the European Economic Area (EEA) at the time of conclusion of the contract, to the exclusion of the UN Convention on Contracts for the International Sale of Goods (CISG). German law shall also apply, to the exclusion of the CISG, to consumers whose habitual residence is outside the EU/EEA. Mandatory consumer protection provisions of the state in which the consumer has their habitual residence shall remain unaffected insofar as they cannot be derogated from by choice of law. Irrespective of this choice of law, mandatory consumer protection law of the state of the consumer's habitual residence shall always apply to consumers within the EU at the time of conclusion of the contract.
13.4 Should one or more provisions of this contract be or become invalid in whole or in part, the validity of the remaining provisions shall remain unaffected.
